Clery Act Compliance Training Academy

The Clery Act Compliance Training Academy (formerly the Advanced Clery Act Training Class) is nationally recognized as the preeminent training program for teaching practitioners how to comply with the complex requirements of the Clery Act. The D. Stafford & Associates (DSA) team has provided instruction to more than 4,000 people since 2011. The Academy features expert instructors with significant knowledge, expertise, and practical experience in conducting audits and training classes for DSA.

This five (5) day training academy is designed to be a comprehensive and intensive training experience. The Academy includes all elements of the Clery Act (which includes the 2008 HEOA security and safety requirements, the requirements of the Violence Against Women Act [VAWA], and the changes that were made as a result of the updated U.S. Department of Education Clery Act Handbook released in June 2016). The training academy experience will benefit individuals who have not had previous Clery Act training, as we start with the basics and work into the advanced concepts. The academy will also benefit those who want to enhance their knowledge of the law. The academy includes a significant amount of training in classifying crimes according to Clery Act Guidelines. The academy features interactive instruction; group exercises; and use of an electronic testing system to reinforce the concepts learned. Each attendee is provided with electronic access to 18 forms and documents that will assist each attendee in developing a system for compliance at their institution. The instructors review and explain the purpose and use of each document throughout the 5 days of instruction.

Advanced Clery Act Compliance Training Academy: Practical Application of the Regulations

The ADVANCED Clery Act Compliance Training Academy is a 3 ½ day training program that provides an opportunity for attendees to build upon the foundation provided in the D. Stafford & Associates Clery Act Compliance Training Academy through a combination of instruction, discussion, and group-based learning activities that explore how to practically apply relevant laws and ED guidance to some of the most vexing issues facing practitioners.

This experience is designed to be interactive, with attendees participating in group analysis and exercises throughout the 3 ½ days. Participants will be able to assess their ability to competently apply the law to specific scenarios and problems while evaluating pertinent operating procedures and practices that relate to complying with the Clery Act.

The class will extend what attendees learned in the DSA Clery Act Compliance Training Academy by:

• using scenarios to provide participants with an opportunity to apply classification and counting rules to specific fact patterns for purposes of accurately classifying and counting crime statistics in accordance with Clery Act definitions and standards;
• providing structured opportunities for practitioner to discuss how to manage the data collection, compilation, reconciliation, and reporting processes to ensure compliance;
• affording participants with the opportunity to analyze what makes a crime log compliant and how to manage the log;
• understanding the key concepts of Clery Geography and how to translate that understanding into formation of a “Clery Map”;
• developing policies and operating procedures for managing Timely Warning Notices and Emergency Notifications; and
• providing opportunities to assess reported incidents and in developing compliant alerts for your campus community.

Registrants will be required to submit various documents via a survey link prior to attending the class, as some of those submissions will be used during the class for purposes of group analysis and assessment.

The class size is limited to allow for a significant amount interactive discussion and group exercises.

Pre-Requisite for Attending:

Attendees must have successfully completed the DSA Clery Act Training Academy after January 1, 2014 to be eligible to attend the Advanced Clery Act Compliance Training Academy. Eligibility will be verified prior to an invoice being issued to the attendee.

The Foundations of the Clery Act

D. Stafford & Associates has partnered with the National Association of Clery Compliance Officers and Professionals (NACCOP) to develop and provide regional, two-day Clery Act training classes around the U.S.

The Foundations of the Clery Act class will provide a basic overview of the requirements of the Clery Act and is suited for people who are new to the Clery Act as well as those who have previously attended Clery Act training, as we continually update the curriculum to include new information received from the U.S. Department of Education based on our questions about practical application of the regulations and Handbook. The regional classes are a perfect way to provide Clery Act training for Public Safety Command Staff and Supervisory personnel who need to have a greater level of knowledge and understanding of the Clery Act. This class is also appropriate for members of Clery Compliance Committees and Student Conduct and Title IX staff members who need a deeper understanding of the requirements of the Clery Act. Finally, this class is also a perfect opportunity to invite the person who supervises the Public Safety unit (VP/AVP, etc.) to obtain additional insights regarding the various requirements of the law.

Investigation of Sex Crimes and Sexual Misconduct for Campus Police/Public Safety and Civil Rights (Conduct/Title IX) Investigators: Conducting Trauma Informed Investigations

Class Description

This 3-day intensive training class is designed for campus police/public safety administrators and investigators (both sworn and non-sworn), student and employee conduct professionals, and Title IX investigators who have responsibility for conducting and overseeing sexual misconduct investigations on their college and university campuses. Attendees will learn how to investigate incidents of sex-based harassment in higher education from start to finish with an emphasis on complying with applicable Clery Act and Title IX regulations and guidance.

Some of the key topics that will be covered include:

• Review of relevant laws, regulations, guidance, and case law;
• Trauma-informed investigation techniques;
• Conducting concurrent investigations;
• Understanding incapacitation;
• Interviewing techniques, including conducting credibility assessments; and
• Understanding campus adjudication process.

Who Should Attend

This class is appropriate for Title IX investigators and other administrators/staff conducting administrative investigations into claims of sexual misconduct, including personnel in campus police/public safety who are involved in conducting criminal or civil rights investigations into these claims.

• For the Campus Police/Public Safety Investigator: This class is appropriate for personnel from sworn and non-sworn agencies from both public and private institutions of higher education who are involved in investigating these types of incidents on their respective campuses. The class will discuss the criminal investigative considerations in addition to the civil rights process. The class will also discuss the intersection of civil rights investigations and concurrent criminal investigations.
• For the Conduct/Title IX Civil Rights Investigator: This class is appropriate for individuals involved in the investigation of sexual misconduct regardless of the type, nature, size, or structure of the institution or the investigation/conduct process. This class will discuss the civil rights investigative considerations in addition to the law enforcement concurrent criminal investigation and provide strategies on how to conduct concurrent investigations.

Certification/Recertification

Attendees of this class will be certified through D. Stafford & Associates. Certification verifies attendance at this class and can serve as an institution’s documentation that the attendee has received training that addresses issues related to sexual assault, including how to conduct an investigation and hearing process that protects the safety of victims and promotes accountability.

Persons who successfully complete this class will be eligible to enroll in the online Sexual Assault Investigations Recertification Training Program to help meet the annual training requirement of the Clery Act, as amended by the Reauthorization of the Violence Against Women Act of 2013.

Through content-based information and practical application, attendees will learn how to fully investigate these offenses from start to finish with an emphasis on investigating the intersections between these offenses and sexual misconduct/assault as well as complying with applicable Clery Act and Title IX regulations and guidance.

Some of the key topics that will be covered include:

• Review of relevant laws, regulations, guidance, and case law;
• Specific considerations when investigating DVDVS, including power and control;
• Working with marginalized populations;
• How to conduct predominant aggressor determinations;
• Trauma-informed investigation considerations; and
• The role of Threat Assessment and Sexual Assault Response Teams.

This class is appropriate for Title IX investigators and other administrators/staff conducting administrative investigations into claims of dating violence, domestic violence, and stalking, including personnel in campus police/public safety who are involved in conducting criminal or civil rights investigations into these claims.

TITLE IX COORDINATOR/INVESTIGATOR CLASS

Class Description

This 4 day intensive training class is designed for campus administrators and investigators who have responsibility for conducting and/or overseeing Title IX compliance and sexual misconduct investigations on their college and university campuses. Attendees will learn how to manage and fully investigate complaints of sexual misconduct, with emphasis on complying with the Clery Act and numerous guidance documents issued by the Office for Civil Rights. The class will include opportunities for discussion and participation in case studies and practical exercises.

Some of the key topics that will be covered include:

• Review of relevant laws, regulations, guidance; and case law;
• Role of the Title IX Coordinator;
• Education and prevention efforts;
• Conducting trauma-informed investigations;
• Understanding incapacitation;
• Conducting credibility assessments; and
• Report writing and adjudication processes.

Who Should Attend

This class is appropriate for Title IX coordinators, deputy coordinators, and investigators; general counsel; administrators in human resources, student affairs/student conduct athletics who conduct civil rights investigations; as well as those non-sworn personnel in campus public safety whose work requires them to conduct civil rights investigations. Advanced Sexual Misconduct Investigations Class

Class Description

This 4 ½ day intensive advanced class is a practical application class specifically designed for graduates of the D. Stafford & Associates “Investigation of Sex Crimes and Sexual Misconduct for Campus Police/Public Safety and Civil Rights (Conduct/Title IX) Investigators: Conducting Trauma Informed Investigations” or the “Title IX Coordinator/Investigator Class.”

Attendees will build upon knowledge gained from the pre-requisite class(es) and develop key investigative skills by actively engaging with case studies and exercises throughout the class.

Some of the key topics that will be covered include:

• Advanced interviewing techniques—Application of trauma informed advanced behavioral interviewing techniques to campus investigations;
• Technology—Utilizing technology in sexual misconduct investigations, as well as interpreting technological evidence in complaints. (Attendees are encouraged to bring their laptops so they can actively apply the concepts with the assistance of the faculty);
• Statement analysis—An investigative tool that involves examination of a person’s verbatim words in written and oral statements to gain insight into a person’s thoughts, motives, and ideas. Statement analysis can be used to help recognize truthfulness and detect possible deception;
• Credibility assessment—Determining the credibility of parties in a complaint; and
• Report writing and preparing the complaint for adjudication—Practical step-by-step guidance for constructing the investigative report that is applicable to police preparing to proceed in the criminal justice process as well as campus administrators constructing their reports for adjudication through a campus process. (Attendees will be provided a DSA Model Report Writing Template).

Attendees will be able to apply the knowledge and skills learned through this class to both civil and criminal investigations.
