Title IX Decision-Maker Training

General Information

The DSA Title IX team has trained over 10,000 Title IX Coordinators, Investigators, Hearing Officers and Advisors across the country and is well-known for delving into the practical application of Title IX. The DSA team, comprised of seasoned practitioners, and all have served as Title IX Coordinators/Deputy Coordinators and Investigators for institutions of higher education. As further changes to the required processes are made by the Office for Civil Rights, those changes are immediately incorporated into all relevant DSA classes.

Title IX Decision-Maker Training

Class Description

D. Stafford & Associates offers a live, virtual Title IX Decision-Maker Training Class appropriate for staff who are designated as decision-makers to determine if allegations of Sexual Misconduct have occurred. The class provides decision-makers with the tools needed to make fair and impartial determinations and addresses the training topics mandated by the Title IX Regulations and the Clery Act at 34 C.F.R. §668.46(k)(2)(ii). The class will provide training on the definition of sexual harassment; the scope of the recipient’s education program or activity; conducting hearings; impartiality, including avoiding prejudgment of the facts at issue, conflicts of interest, and bias; using technology at a live hearing; and issues of relevance of questions and evidence; and other institution-specific issues related to hearings and decision-making.

Some of the key topics that will be covered are:

  • The definition of sexual harassment in § 106.30.
  • The scope of the recipient’s education program or activity.
  • Training on any technology to be used at a live hearing.
  • How to conduct an investigation and grievance process including hearings, appeals, and informal resolution processes, as applicable.
  • Issues of relevance of questions and evidence.
  • Including when questions and evidence about the complainant’s sexual predisposition or prior sexual behavior are not relevant.
  • How to serve impartially, including by avoiding prejudgment of the facts at issue, conflicts of interest, and bias.

Who Should Attend

This course is appropriate for staff who are designated as decision-makers to determine if allegations of Sexual Misconduct have occurred, including but not limited to people who are assigned as a single investigator and/or individuals who are part of a hearing panel. If you are responsible for hearing Appeals, you should register for the Appellate Officer Class offered by our sister organization, the National Association of Clery Compliance Officers and Professionals.

Faculty

This training program will feature expert faculty who serve or who have served as practitioners on college and university campuses throughout the country in the areas of behavioral intervention and threat assessment, student conduct, Title IX, human resources, and legal affairs.

Logistics

This class is an 8-hour class (with time built in for breaks).

Virtual Classes: The live, virtual classes are held:

  • 2 consecutive days from 12:00 pm – 4:30 pm Eastern Time each day.
